Dismissal With Prejudice In Dram Shop/Civil Damages Act Case
Rich Sobalvarro and Eric Oelrich obtained a dismissal of a dram shop death case in the 10th District of the Minnesota District Courts. There were 12 named Plaintiffs. The Court found that the Plaintiffs did not commence their lawsuit within the applicable 2 year statute of limitations. There was not a reported appellate case analyzing the specific service statutes at issue. The Court adopted our client’s argument about when the lawsuit was commenced in full, and dismissed the case with prejudice.
