Attorneys Paul Rajkowski and Steven Bader win Summary Judgment in Property Damage Case

Attorneys Paul Rajkowski and Steven Bader won summary judgment in defense of a property damage subrogation case. The building constructed by the plaintiff's insured collapsed in a wind storm. The plaintiff's insured designed the building and oversaw construction. He obtained a materials bid from a supplier for his design, and he took that materials list to our client for a second bid. Contrary to the plaintiff's theory, the undisputed record showed that our client did not provide any design services or labor related to the building. Instead, it simply supplied the materials on the list provided by the plaintiff's insured. Accordingly, the court dismissed the plaintiff's negligence, breach of contract, and breach of warranty claims on summary judgment.
