Rajkowski & Bader win summary judgment

Attorneys Paul Rajkowski and Steven Bader won summary judgment on a premises liability personal injury suit. The plaintiff slipped and fell outside of a Target store. She sued Target and its snow removal vendor for her alleged injuries. The undisputed record showed the accident occurred during an ongoing weather event. Minnesota law allows property owners to await the end of a winter weather event and a reasonable time thereafter to clear ice and snow. The plaintiff attempted to defeat summary judgment with weather records that purported to show clear weather at the time of the accident. The court found the records lacked foundation, and held that the undisputed record showed Target and its snow removal vendor had no duty of care to clear ice and snow at the time of the plaintiff's accident.
