December 3, 2009 - Judge Grants Summary Judgment in Slip and Fall Case
Paul A. Rajkowski and Eric S. Oelrich, attorneys at Rajkowski Hansmeier Ltd. in St. Cloud, MN recently argued a motion for summary judgment regarding a slip and fall that allegedly occurred on the Defendant's property.  The court granted a motion for summary judgment as the Plaintiff could not establish the exact cause of the injuries she claimed.

November 12, 2009 -
Crow Wing County Judge Grants Summary Judgment in Negligent Case
Gordon H. Hansmeier and Kristi D. Stanislawski, attorneys at Rajkowski Hansmeier Ltd. in St. Cloud, MN successfully drafted and argued a motion for summary judgment regarding the installation of a culvert by a township.  In granting summary judgment, the Crow Wing County court found that the two-year statute of limitations to improvements to real property had barred Plaintiff's claims.

October 27, 2009 -
A Federal Judge Grants Summary Judgment in Liability Case
Gordon H. Hansmeier and Eric S. Oelrich, attorneys at Rajkowski Hansmeier Ltd. in St. Cloud, MN successfully drafted and argued a motion for summary judgment regarding the duty owed by a vegetable oil manufacturer to place risk warnings on the product packaging of spontaneous combustion.  In granting summary judgment, the federal court found that the oil manufacturer did not owe a duty to the Plaintiff to warn against the alleged duty to warn.

August 27, 2009 - Douglas County Jury Grants Defense Verdict in Automobile/Bicycle Case
Troy A. Poetz, an attorney at Rajkowski Hansmeier Ltd. in St. Cloud, MN received a defense verdict from a jury in Douglas County.  The jury found that the Plaintiff's negligence caused the accident as she darted into traffic, and therefore the Defendant was not liable.

August 20, 2009 - Troy A. Poetz Elected to the Minnesota Defense Lawyers Associaion Board of Directors
The Minnesota Defense Lawyers Association (MDLA) met for its annual meeting from August 13-15, 2009 in Duluth.  At the annual meeting
Troy A. Poetz, an attorney at Rajkowski Hansmeier Ltd. in St. Cloud, MN was elected to a two year term on the MDLA's Board of Directors.


August 20, 2009 - Paul A. Rajkowski Elected to DRI State Representative
Paul A. Rajkowski, managing partner at Rajkowski Hansmeier Ltd. in St. Cloud, MN has been elected to the position of DRI State Representative.  This position through DRI (The Voice of the Defense Bar) is a liaison position through DRI and the Minnesota Defense Lawyers Association (MDLA).  Paul will start this position in October 2009.
June 4, 2009 - Benton County Judge Grants Defense Motion
Paul A. Rajkowski and Jessie L. Becker, attorneys at Rajkowski Hansmeier Ltd. in St. Cloud, MN were granted a defense motion from a Judge in Benton County.  The Judge found that the Plaintiff's motion to make an audio recording a condition of the Defendant's Independent Medical Exam ("IME") was not sufficient, and therefore will not be allowed.

May 20, 2009 - Attorneys Host Employment Law Lunch
Employment Law attorneys from Rajkowski Hansmeier Ltd. in St. Cloud recently held their annual spring employment law lunch for clients and potential clients interested in employment law issues. 
Lori L. Athmann, an attorney with the firm, presented information on the American Recovery and Reinvestment Act of 2009 (ARRA) and the Consolidated Omnibus Budget Reconciliation Act (COBRA).  The discussion of these acts was geared toward lay offs and other difficult issues arising due to the state of the economy.  A copy of the information presented can be obtained by clicking here.

A good discussion between the employment law attorneys and the participants was held on different issues that arise in human resources, specifically those pertaining to COBRA.

May 20, 2009 -
Chisago County Jury Grants Defense Verdict in Dog Bite Case
LeAnne Miller, an attorney at Rajkowski Hansmeier Ltd. in St. Cloud, MN received a defense verdict from a jury in Chisago County who found that provocation was present and therefore a homeowner was not liable for any injuries that may have resulted from a dog bite.

May 7, 2009 -
Otter Tail County Judge Grants Summary Judgment in Liability Case
Kevin F. Gray and Jessie L. Becker, attorneys at Rajkowski Hansmeier Ltd. in St. Cloud, MN successfully drafted and argued a motion for summary judgment regarding the duty owed by a landlord to warn his tenant of the potential harm of a clothesline in the yard.  In granting summary judgment, the district court found that the defendant did not owe a duty to the Plaintiff to warn against the alleged potential risk of an open and obvious hazard.

April 21, 2009 -
Otter Tail County Grants Defense Verdict
Frank Rajkowski, an attorney with Rajkowski Hansmeier Ltd. in St. Cloud, MN recently received a defense verdict from a jury in Otter Tail County. The jury found the individual who attempted to prevent a fight was not negligent.

April 20, 2009 -
Kandiyohi County Judge Grants Summary Judgment in Insurance Coverage Case
Paul A. Rajkowski and Matthew W. Moehrle, attorneys with Rajkowski Hansmeier Ltd. in St. Cloud, MN successfully drafted and argued a motion for summary judgment on an issue of coverage. In granting summary judgment the district court found coverage was excluded from the insurance company's policy when injury resulted from the insured's actions in furtherance of a crime.

March 31, 2009 -
Stearns County Judge Grants Summary Motion
A Stearns County judge granted a motion for summary judgment based on the plaintiff’s primary assumption of the risk. 
Troy A. Poetz, an attorney with Rajkowski Hansmeier Ltd. in St. Cloud, MN successfully argued an individual who sustained injuries during a towing incident assumed the risk by getting under the car on the roadway.

March 1, 2009 - Barbara Zierden Asked to Join the Minnesota Secretary of State Business Rewrite Focus Group
Barbara Zierden, a paralegal with Rajkowski Hansmeier Ltd. in St. Cloud, was asked to join the Minnesota Secretary of State Business Rewrite Focus Group. The group is in the process of re-writing the Secretary of State's business and uniform commercial code computer systems. The group will review recent survey results from users of the system and implement an action plan to create user-friendly systems on the Secretary of State's website.


June 25, 2009 - St. Louis County Grants Defense Verdict in Injury Case
Frank J. Rajkowski, a partner at Rajkowski Hansmeier Ltd. in St. Cloud, MN received a defense verdict from a jury in St. Louis County who found that warnings were given to the Plaintiff that a recycling area was slippery before she slipped and fell on the ice.  The area had also been sanded by maintenance men prior to the incident.

June 24, 2009-
